Terms & Conditions

THIS AGREEMENT (“the Agreement”), made as by and between Right-On Studios (the “Owner”), and You (the “Renter”) collectively, the “Parties”. This agreement will remain in effect for current and future Studio rentals for the renter. The parties agree as follows:

Studio Rental

Owner hereby grants a limited and revocable license (the “License”) to the Renter to use rental studios at Right-On Studios (the “Studio”). If minors are using the Studio, THEY MUST BE ACCOMPANIED BY AN ADULT, that will accept liability for the parties using the Studio.

Prohibited Activities:

The following are not permitted at Right-On Studios:

• Weapons of any kind.
• Smoking, vaping or smoke of any kind.
• Pets or Animals with the exception of service animals.
• Alcohol of any kind.

General Rules:

• Our rental agreement form must be signed before the first rehearsal.
• Payment must be submitted before the beginning of each rehearsal. -For payment, we accept debit/credit cards (NO CASH).
• We require at least 24 hours notice before cancellation, or 100% room fees will apply. -When time is booked, no refunds for arriving late or rehearsals cut short.
• Rehearsals must end on time, according to the booking schedule. -NO pets, smoking, alcohol, drugs or weapons allowed on the property.
• All underage band rehearsals require an adult to be present at all times. -Do not leave any food or sugar drinks that could attract ants in the trash cans.
• Contact owner, Dan Achin, by text or phone call if your access code has not been emailed at least 1 hour before rehearsal.
• Contact the owner, Dan Achin, by text or call if you have any problems with the locks.
• Make sure lock-box is shut after retrieving key, before unlocking building.
• Never lock the front door if people are still in the building. Fire Hazard!
• When you leave, lock the rehearsal room, hallway door and front door.
• Turn off all lights, amps and fans and set air conditioning units to auto/off.

SURVEILLANCE and Disclaimers:

The Studio shall be provided by the Owner as-is and Owner make no warranty regarding the suitability of the Studio for Renter’s intended use.

Right-On Studios is monitored by video surveillance 24/7 to help ensure the safety and security of all guests, staff, and property. By using the premises, the Renter acknowledges and consents to being recorded while on-site.

Video recordings may be reviewed in the event of a safety concern, property damage, unauthorized activity, or any dispute requiring resolution. Recordings are stored securely and will not be shared publicly unless required by law enforcement or legal proceedings.

Cameras are never placed in private areas, such as restrooms or other locations where individuals may reasonably expect privacy.

Condition:

After the completion of the reservation, the Renter shall leave the Studio in the same or similar condition as received from the Owner.

Clean-up

Renter will be responsible for clearing all trash generated during the reservation and depositing it in the proper waste receptacles on site.

Damage:

Beyond ordinary wear and tear, Renter shall be responsible for any damage caused by Renter’s use of the Studio. Renter shall arrange for the repair of any such damage. In the event if Renter does not make any necessary repairs, Owner shall arrange for the same at Renter’s expense.

Right of Entry:

Owner shall have the right to enter the Studio at any time for any reasonable purpose, including any emergency that may threaten damage to Owner’s property or injury to any person in or near the Studio.

Indemnification:

Renter hereby indemnifies and holds harmless Owner from any damages, actions, suits, claims, or other costs (including reasonable attorneys’ fees) arising out of or in connection with any damage to any property or any injury caused to any person (including death) caused by Renter’s use of the Studio, including any acts or omissions on the part of Renter, its employees, officers, directors, independent contractors, or other agents. Renter shall notify Owner of any damage or injury of which it has knowledge in, to, or near the Studio, regardless of the cause of such damage or injury.

Cancellation:

Renter may cancel the reservation by notifying Right-On Studios. If the reservation is canceled within less than 24 hours notice, the renter will be charged full price for the reservation. Exceptions can be made for last minute illnesses and emergencies.

Assignment:

Neither Party may assign or transfer their respective rights or obligations under this Agreement without prior written consent from the other Party.

Governing Law:

This Agreement shall be construed in accordance with, and governed in all respects by, the laws of the State of California, without regard to conflicts of law principles.

Release of Liability:

I hereby assume all the risks associated with participating in activities with Right-On Studios, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am willing and able to participate in activities with Right-On Studios, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in such activities. I acknowledge that this Release of Liability Form will be used by Right-On Studios, its partners and affiliates of the activities in which I may participate, and that it will govern my actions and responsibilities at said activities. In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: Right-On Studios and/or their directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers; (B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise. I acknowledge that Right-On Studios and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity. I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns. The Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

Entire Agreement:

This Agreement constitutes the entire agreement between Renter and Owner, and supersedes any prior understanding or representation of any kind preceding the date of this Agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement.
